Terms of Use
The rules for using New Around, and what happens to the content you send us.
Draft — not yet complete. The operator details on this page are still placeholders. Fill in lib/legal.ts before this site is treated as legally compliant.
1. Who we are and what this covers
These terms govern your use of newaround.com and our mobile app (together, “New Around”). By using the service you accept them. If you do not accept them, please do not use the service.
2. What New Around is
New Around is an editorial directory of recently opened restaurants, cafés, bars and hotels. We collect information from public sources, our own visits and community submissions, and we curate what gets published.
We are independent of the venues we list. A listing is not an endorsement, not an advertisement, and not a booking or reservation service. We do not take payment from visitors, and browsing is free.
3. Accuracy
We take care to get listings right, but venues change without telling us — hours shift, menus change, places close. We make no warranty that any detail is complete or current, and you should verify anything that matters to you directly with the venue before relying on it.
4. Submitting a place
Anyone can suggest a venue. Submissions are reviewed before publication, and we decide at our discretion whether to publish, edit or reject one. Submitting something does not entitle you to have it published.
When you submit content, you confirm that:
- the information you provide is accurate to the best of your knowledge;
- you own the rights to every photograph you upload, or have permission from the rights holder to license it to us on the terms below;
- the photographs are your own work or the venue's own material — not taken from Google Maps, TripAdvisor, Instagram, Facebook, a delivery platform or any other site;
- any identifiable person shown in a photograph has agreed to it being published;
- the content does not infringe anyone's copyright, trade mark, privacy or other rights, and is not unlawful, defamatory or misleading.
5. The licence you grant us
You keep the copyright in everything you submit. You do not transfer ownership to us.
You grant us a non-exclusive, worldwide, royalty-free, transferable licence to store, reproduce, crop, resize, re-encode and publish the content you submit, for the purpose of operating and promoting New Around — on the website, in the app, in our newsletter and on our social media channels.
The licence lasts as long as the listing is published. You can withdraw it at any time by writing to contact@newaround.com; we will remove the content within a reasonable period. Copies already distributed outside our control — a newsletter already sent, a social post already shared — cannot always be recalled.
If you would like to be credited as the photographer, mention it in the notes when you submit, or email us later, and we will show your name with the photos.
6. Our own content
Texts, design, photographs we took ourselves and the compiled directory are protected by copyright and belong to us or our licensors. You may link to our pages and share them freely. You may not copy the listings wholesale, scrape the site in bulk, or reuse our content commercially without our written permission.
7. If you are a venue
If you run a venue listed here and want the listing changed, corrected or removed, email us and we will take care of it. There is no charge for this.
If you send us photographs of your venue, section 5 applies to them as well — we take that as your permission to publish them.
8. Reporting a rights infringement
If you believe content on New Around infringes your rights, contact us at contact@newaround.com and tell us what the material is and where it appears. We remove disputed content without delay while we investigate. You do not need a lawyer to do this, and a formal warning letter is not necessary — an email is enough and is always faster.
9. Acceptable use
You agree not to:
- submit false, spam or promotional content disguised as a genuine suggestion;
- attempt to gain unauthorised access to any part of the service;
- use automated means to extract data from the site beyond ordinary search engine indexing;
- interfere with the operation or security of the service.
We may restrict or block access if you do.
10. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For slight negligence, we are liable only where we breach an obligation essential to the purpose of these terms, and then only for foreseeable damage typical of this kind of agreement. Any further liability is excluded.
We are not responsible for the content of external websites we link to, nor for your experience at any venue listed here.
11. Availability
We do our best to keep New Around online, but we do not guarantee uninterrupted availability. We may change, suspend or discontinue features at any time.
12. Changes to these terms
We may update these terms when the service changes. The current version is always the one published here, dated at the bottom of the page. Continuing to use the service after a change means you accept the updated terms.
13. Governing law
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
Should any provision of these terms be or become invalid, the remaining provisions remain in effect.
